  1. How do I access the electricity cupboard and meter?

  2. Who pays for repairs and maintenance?

  3. How do I set up Sky TV in my apartment?

    Refer to the attached Sky Setup Sheet.

  4. Can I install a peephole or deadlock in my apartment? 

    Fire regulations require that any front door modifications such as installing deadlocks or peep holes are performed by an authorised locksmith. A deadlock that can only be opened with a key from the inside is not permitted.

    If any lock is changed on your door please ensure a new key for the Secure Key Cabinet is given to the Building Manager.

  5. Who do I advise if I want to make alterations to my apartment or building?

    The BCC must give approval in advance of any work involving alterations to any apartment, common area, commercial property or the appearance and structures in/around the Montreaux building. This includes alteration of the appearance, surface colour, decoration or design of the exterior of the Unit.

    Failure to obtain approval from the BCC could mean reversing any work completed and making good any other items related to the work undertaken.

    Owners are also required to check whether a Building Consent or an Electrical Code of Compliance is required, and obtain them prior to any work commencing.

  6. Can I take insure my own unit instead of having it insured by the BC?

    No. The Unit Titles Act requires that the body corporate maintains a full replacement policy for all the improvements on the land.

  7. Who is responsible for insuring the contents of my apartment?

    Contents are the responsibility of each resident.

  8. What insurance should I arrange?

    As well as Residents arranging their own contents insurance, Owners should also insure all items that can be removed from the unit such as window dressings and carpets not glued down, and appliances which are not permanently wired.

    Loss of Income and/or Landlords insurance is the responsibility of Unit Owners.

    Anything permanently fixed in the apartment is covered by the BC insurance, and claims can be made against the BC insurance if over the relevant excess.

  9. How is my share of the body corporate levy calculated?

    Every unit has a Unit Entitlement, which is recorded on the Unit Plan held at Land Information New Zealand. The Body Corporate is obliged to maintain a fund sufficient to meet its obligations, and levying proprietors in proportion to their unit entitlement creates that fund.

  10. What can I do if I believe that the share of the levy I am required to pay is unfair?

    The law does not provide any basis for calculating levies other than unit entitlement. The exception is repairs or acts that benefit one or some proprietors, but not all, and where the benefit to individual owners is a distinct and ascertainable amount. Based on the legal precedents available very few expenses meet this criterion.

    The only way to change your unit entitlement is by way of a redevelopment plan as described in Section 44 of the Unit Titles Act. This requires the unanimous consent of all owners and their mortgagees. It is an expensive and time consuming process and costs may exceed benefits.

  11. Since I own a share of the common property can I use it to park my car, store my possessions, make a garden, host a social gathering or some other form activity?

    No. Under special circumstances exceptions may be allowed by prior consent of the BCC.

  12. Is there a post box for the delivery of over-sized or courier items?

    A parcel box is located in the foyer, to take over-sized packages that do not fit in letter boxes. NZ Post and Courier Post should place a yellow notification card in the resident’s letter box when they deliver packages (the card should be returned to the container in the box).
